These measures, adopted by MEPs, introduce stricter procedures for migrants who have received expulsion orders, and may affect Kenyans living without legal status in countries such as the United Kingdom, Germany, Italy and other European countries. «According to the legislation, a decision on return issued by the competent national authorities to a citizen of a non-EU country who is in a member state illegally will be accompanied by an obligation to leave the relevant EU country immediately or within a specified period», the EU statement said.
Under the new system, third-country nationals who receive a decision to return will be required to cooperate with the authorities and leave the country either immediately or within a specified period. The legislation is designed to simplify and speed up deportation procedures while respecting international law and protecting fundamental human rights. The rules also allow authorities to detain individuals subject to deportation if they are considered likely to flee, refuse to cooperate, or pose a security threat.
The US Department of Homeland Security has ordered ICE to begin raids and deport illegal immigrants involved in the voting scandal. Detention can last up to 24 months, with a possible extension of six months under certain circumstances. Authorities may also require affected individuals to check in regularly, stay in designated areas, or comply with electronic control measures. «An extension of up to six months in total will be possible if circumstances change, new information becomes available, or cooperation with a third country improves», the parliament said. In addition, national authorities will be allowed to conduct investigations to facilitate return, including searches of residential premises and personal belongings, subject to judicial or administrative authorization and compliance with legal safeguards.
A key provision of the legislation allows member States of the European Union to transfer migrants subject to deportation to special «return centers» in non-EU countries that agree to accept them. Such agreements can only be concluded with countries that respect human rights, international law and the principle of non-refoulement.
The legislation was approved by the European Parliament with 418 votes in favor, 218 against, and 30 abstentions. It still needs to be officially adopted by the Council and published in the Official Journal before it comes into force. What this means for Kenyans in the UK, Germany and Italy For Kenyans legally residing in Europe with valid visas, work permits, residence permits or citizenship, the new rules should not affect their stay. However, those living in EU countries illegally may face faster deportation procedures, stricter monitoring requirements and longer periods of detention under the new system. In addition, if a Kenyan staying in the United States overstays his stay in the European Union and does not comply with the decision to return, he must be banned from entering the European Union.
